The third point that has been introduced I would like to say that in terms of
the control of administration by parliament which exists almost everywhere which everyone sees and hears. There
was an inquiry commission. It was introduced in 1996 if my memory is good so that parliaments can constitute and
fall on parliamentary commissions.
I am not going to speak about justice independence. In terms of justice we had amendments, sanction of judges,
creation of ad hoc tribunals, federal courts, commerce courts, because it seems very important for the investor
not to be subject to the classical justice but rather specialized justice with well trained judges so in order
to respect the time allotted to my presentation I would like to raise the questions because we are aware of these
reforms the country but they are imposed on us also from outside. First of all when we say the public function
is…that is democracy, it is true because when we examine and see the weight of the wage, it is wrong because when
we see the minimum level of the population, when we provide services .. civil access, it is very important but
there is not rationalizing and this is very important in democracies, one civil servant for instance for 1,000,000
inhabitants so why is this wage imposed on us. What can we say about the investors from foreign countries, western
countries also from democracies will come to propose the commissions as well as to the functions.
One more element I would like to add within the framework of good governance, we created regional accords in order
to improve the control over the elected people. I will stop at this point or Madam will cut my ears.

Sukehiro Hasegawa: I am from the UNDP from Japan. I would like to take two aspects that you mentioned. The
first one is for good governance particularly in economic affairs and I would like to relate the importance of
avoiding the mismanagement of the economic sectors. In a number of emerging countries, not invited here but Indonesia
has a democratic society but these countries have gone through major financial crises as all of us know and the
loss of goods and services is estimated to reach about two trillion dollars for the past two years and this resulted
from mismanagement on the part of national and international financial officials. When we look at the national
governance we have to also look at global governance and I would like to relate so much technicalities but the
one importance of trying to build the national capacity to deal with very difficult economic management. Advice
given by international authorities sometimes are not quite perfect and going through the trouble and it is very
difficult to divorce. 40,000,000 to 50,000,000 people have lost their jobs and they continue to suffer.
What is very pertinent being in New York to notice is that global continues to provide a benefit to emerging countries
but in essence they are in pursuit of their own benefit and profit. Therefore, the largest country that I work
physically in New York, the greatness of the United States continues to bring in 600,000 to 700,00 immigrant and
perhaps the Chairperson can verify the exact number but I understand that 100,000 to 150,000 immigrants continue
to be a very well talented economists and other scientists. I think it is very incumbent on emerging countries
to try to retain their national talents. They are quite willing, they want to stay in their countries if they are
given responsible positions.
Second point I have relates to the rule of law and I make it very short that globalization is taking the toll in
increasing the trafficking of international criminalities, the Mafia are increasing their activities, the private
use and 300- 400 women are forced to engage in … professions and so forth. I think the International Criminal Court
that the general assembly court appointed last year is about to be established and we hope this will add a support
to the countries in avoiding criminalities.
Madam Speaker: Thank you very much. The next speaker on my list is Mr. Sadi from Morocco but since we have
had a speaker from Morocco, I hope you will concur that if time is left over we can turn to you.
Speaker: Thank you, Madam Speaker. I would like to refer to two points very briefly. We are speaking about
the modernization of the state. We come to this point we would say that we could qualify this as the lack of professionalism
of the public servant and this is a problem. I am going to give you an example that we are experiencing in El Salvador.
